Trading name 問題

設一公司: ABC Groups Ltd Trading name : ABC shop （這 Trading name 沒有註冊商標） 另一公司： XYZ Ltd 股東： ABC Groups Ltd20% X 先生80% 請問，XYZ Ltd 開店，取名”ABC shop" ，這做法是否合法？是否須要取得 ABC Groups Ltd 書面同意？ 謝謝

It is a principle of whether ABC is a registered trade mark of ABC Group Ltd. Generally speaking, if ABC is just a general name, then XYZ Ltd could use this. If this is a registered name or trade mark, then XYZ has to obtain a written consent from ABC Group or else, ABC could injunct XYZ from using it. It is advisable you put the matters to be discussed with Mr. X and exchange the views. Or, you could give documents and information to your lawyer for legal advice.
